What damages could be recovered by the Plaintiff. Clearly the value of the Horses would be recoverable by the owner. In any civil action a plaintiff can also try and recover damages for pain and mental anguish. Despite the fact there has been no personal injury to the owner, it may still be worth pursuing. Each and every owner spent an enormous amount of time training these animals and the death could cause some extreme emotions. Is it recoverable in court? Only time will tell.
