FLORIDA PERSONAL INJURY BLOG: Investigators Still Searching For Who Is To Blame In Disney Monorail Accident

The National Transportation Safety Board (NTSB) is still working its way through documents in Lake Buena Vista, FL trying to determine what caused the monorail accident at Walt Disney World that took the life of 21-year-old Austin Wuennenberg. Wuennenberg died of blunt force trauma to the head and chest. Injuries to his spleen also played a role in his untimely passing. Orange County Sheriff’s investigators have gone on the record saying that the driver of the monorail that crashed with Wuennenberg’s was not at fault. They said that the error could have been caused by a computer or an operator who flipped a switch to put both trains on the same track. The NTSB has said that Disney has cooperated with all their requests for documents. Wuennenberg’s family filed paperwork in Orange County Courts last month looking to block Disney World from getting rid of any of the evidence in the case as there may be a potential personal injury lawsuit in the future.

The State Supreme Court settled the debate over whether undocumented workers could sue for future lost wages in 2006 but this case is the first where political asylum was brought into the equation. The defense is arguing in this particular case that the worker cannot sue for future wages if his political asylum is denied and he is sent back to Kosovo. The judge eventually instructed the jury that future earnings could be applied and that the defense was to make no mention of the plaintiff working in this country illegally.
